Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "User," or "Subscriber") and THORE Agency ("THORE," "we," "us," or "our"), governing your access to and use of Aevra AI Voice Receptionist software, websites, telephony trunks, APIs, and dashboard portals (collectively, the "Platform").

By registering for an account, deploying an Aevra phone number, connecting call-forwarding, or authorizing payment, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Service Description & AI Receptionist Capabilities

Aevra provides automated 24/7 inbound and outbound conversational voice software for local service businesses. The service includes automated call answering, lead qualification, appointment booking, CRM data synchronization, and transactional SMS notifications.

  • AI Nature of the Platform: Aevra operates via natural language processing and synthetic speech generation models. While engineered for high accuracy, automated voice models may occasionally misinterpret caller intent or ambient background audio.
  • Emergency Services Disclaimer: Aevra is NOT a 911 or emergency dispatch service. The Platform cannot be configured for emergency response, life safety systems, or hazardous dispatch.
  • Client Review: The Client maintains sole operational responsibility for verifying appointment schedules, emergency job alerts, and lead follow-ups.

3. Telephony, Recording & Consent Compliance

Telephony and voice communications are subject to federal and state wiretapping, surveillance, and recording regulations. The Client agrees to comply with all applicable laws, including:

  • Two-Party / All-Party Consent: In states requiring mutual consent for telephone recording (such as California, Florida, Illinois, Pennsylvania), Client agrees not to disable or suppress automated greeting notices informing callers of recording or AI processing.
  • TCPA & 10DLC Regulations: Client represents and warrants that all phone numbers submitted for outbound automated SMS or voice follow-up have received appropriate TCPA-compliant consumer consent.
  • Robocalling & Harassment Prohibitions: The Platform may never be used for unlawful automated cold telemarketing, robocalling, spoofing, extortion, or harassment.

4. Subscriptions, Invoicing & Cancellation

Aevra software plans are billed on a recurring monthly or annual basis via Stripe.

  • Billing Cycle: Subscriptions renew automatically at the start of each billing period unless cancelled prior to the renewal date.
  • No Long-Term Lock-In: Month-to-month subscriptions may be cancelled at any time through the Client Portal or by emailing support. Cancellations take effect at the conclusion of the paid billing cycle.
  • Overages & Telephony Minutes: Monthly tiers include defined minute and phone number allocations. Extra usage is billed at standard metered rates disclosed in your tier agreement.

5. Intellectual Property & Client Data Ownership

Client Data Ownership

You retain all rights, title, and interest in and to your business records, caller contact details, CRM data, and customized prompts ("Client Data"). We claim no ownership over your leads or customer interactions.

Platform Intellectual Property

All proprietary software, code, algorithms, visual designs, voice orchestration pipelines, and brand assets of Aevra and THORE Agency remain the exclusive property of THORE Agency.

6. Limitation of Liability & Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

  • THORE Agency does not warrant that telephone connections will be uninterrupted, error-free, or compatible with every PBX carrier trunking system.
  • Under no circumstances shall THORE Agency be liable for lost profits, lost business opportunities, missed appointment damages, or consequential damages resulting from telecom carrier outages, AI misinterpretation, or downstream CRM sync delays.
  • Our aggregate cumulative liability arising under these Terms shall not exceed the amount actually paid by you to THORE Agency for the specific service in the three (3) months preceding the incident.

7. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Sacramento County, California.
